N12 applications face intense scrutiny. A minor error in the termination date, failure to pay compensation on or before the termination date, or lack of a sworn affidavit will result in immediate dismissal.

Is compensation mandatory?
Yes. For an N12 notice, the landlord must pay the tenant one month's rent as compensation (or offer another acceptable rental unit) on or before the termination date listed in the notice. Failure to do so will result in the dismissal of your application.
Can I evict to sell the property?
No. You cannot issue an N12 simply because you want to sell the property vacant. You can only issue an N12 for "Purchaser's Own Use" after a valid Agreement of Purchase and Sale has been signed, and the purchaser (or their immediate family) requires the unit.
What happens if they claim "Bad Faith"?
If a tenant claims bad faith, the Board will examine your intent. If the landlord re-rents, lists, or sells the unit within 1 year of the tenant vacating, the Board presumes bad faith, which can lead to significant fines (up to $50,000 for individuals) and damages awarded to the tenant.
