Ontario LTB matters (Residential Tenancies Act)

Conduct, Safety & Illegal Acts
(N5, N6, N7 / L2)

From noise and nuisance (N5) to illegal acts (N6) and serious safety threats (N7). We determine the correct eviction pathway to protect your property and liability.

When This Applies

  • Substantial interference with reasonable enjoyment (N5)
  • Willful or negligent damage to the rental unit (N5)
  • Serious impairment of safety (N7)
  • Illegal acts, drug production, or trafficking (N6)

The Core Risk

Conduct applications are evidence-heavy. Whether it is a voidable issue (N5) or a serious safety threat requiring immediate termination (N7), the Board requires a waterproof evidence log.

The Strategy: Choosing the wrong notice (e.g. N5 instead of N7) can delay eviction by months. We analyze the facts to select the strongest legal ground.

What We Do

We transform complaints into a structured legal case suitable for adjudication.

01

Evidence Assembly

  • Consolidate incident logs (dates, times, specific details)
  • Organize multimedia evidence (photos, videos, audio)
  • Format third-party reports (police, bylaw, witness statements)
02

Notice Selection & Drafting

  • Determine if the issue requires N5, N6, or N7
  • Draft detailed particulars / incident details (Critical step)
  • Identify if the notice is voidable (7-day remedy) or non-voidable
03

L2 Application & Hearing

  • File the L2 as soon as eligible based on the notice and ground
  • Prepare a comprehensive evidence brief for the Adjudicator
  • Provide representation to argue for termination and costs

Safety threat or illegal act? Don't wait.

Serious issues (N6/N7) allow for expedited timelines. We review the facts to see if you can bypass the standard N5 voiding period.

Key Evidence Required

The LTB relies on specific documentation to prove conduct issues. We utilize:

Detailed Incident Logs
Photos/Videos of Damage
Police / incident reports (strong supporting evidence for N6 matters)
Repair Invoices / Quotes
Written Complaints from others

Frequently Asked Questions

Understanding the difference between N5, N6, and N7.

What is the difference between N5 and N7?
An N5 is for general interference or damage and is "voidable" (the tenant can fix it in 7 days to stay). N7 is used for serious safety issues; it may allow faster steps depending on the ground. We confirm the correct pathway.
Can the tenant void the N5 notice?
Yes, if it is the first N5. The tenant has 7 days to stop the behavior or pay for the damages listed. If they comply within that window, the notice is void. However, N6 (illegal acts) and N7 notices are generally not voidable.
When can I use an N6 for Illegal Acts?
An N6 is used when a tenant commits an illegal act in the unit (e.g., drug trafficking, production). This is a serious notice with short timelines. Police reports or strong evidence are typically required to succeed at the Board.
